Penalties from the Military

If you are a member of the military and were arrested for a DUI, the penalties you may face depend on a number of factors, including your rank and the specific branch to which you belong. Additionally, you may face more harsh penalties if you have proper alcohol or drug related incidents. Possible penalties may include, but are not limited to the following:

-      Dishonorable discharge

-      Loss of pension

-      Reduction in rank and pay

-      Monetary fines

-      Loss of security clearance

-      Imprisonment

-      Restriction of movement

-      Substance abuse courses and/or evaluation

-      Negative performance report

If you are convicted of a second or subsequent DUI, you will likely be expelled from military service. In some cases, your command may make exception to this rule if they feel you are an exceptional asset.

Penalties from California court

Following your sentencing from the military, you will also be required to face civilian court. Possible penalties from California court may include, but are not limited to, the following:

-      Monetary fines

-      Public service

-      Alcohol and/or drug education classes

-      Loss of drivers license

-      SR22

-      Probation of 5 or more years

-      Requirement to wear an Ignition Interlock Device

If you are a member of the military facing a DUI charge, it is incredibly valuable to hire a local attorney with a wealth of experience dealing with these types of DUI cases. We strongly suggest keeping track of all documents relating to your case and documenting everything that occurs in relation to military punishment.
